PIL filed for ‘Uttarakhand Hooch Tragedy’ in Uttarakhand High Court.

A Public Interest Litigation (PIL) was argued by Advocate Naman Kamboj (Managing Partner Litigo Law Chambers & Management head indianlegalsolution.com) in High Court of Uttarakhand at Nainital on 13th February for seeking the indulgence of the Hon’ble High Court in the ‘Uttarakhand Hooch Tragedy’ -where more than 100 people died due to consumption of home-made illicit liquor.

The bizarre and outlandish unfortunate tragedy took place on 7th February when soon after consumption of home-made illicit liquor people started dying. It was alleged in the PIL that the State Instrumentalities miserably failed to discharge the duties to control/curb the manufacture and sale of the illicit liquor in the State.

It was also contended that State Government of Uttarakhand is taking the matter lightly and deliberately to safeguard the higher officials have suspended the officers of lower ranks including the SHOs, Excise Inspectors and Constables. Unlike Uttarakhand Government, the Uttar Pradesh Government has constituted five members Special Investigation Team (SIT) headed by ADG (Railways) and has also suspended the officers including Deputy Superintendent of Police (DSPs), District Excise Officers and so on.

The said PIL was filed for preserving the fundamental rights, of the family members of ‘Uttarakhand Hooch Tragedy’ victims, guaranteed under Article 21 of the Constitution of India.

HC admitted the Petition and directed the respondent no. 1 and 3 to submit report within 10 days and the court also asked why action was not taken against District Excise Officer? PIL filed for ‘Uttarakhand Hooch Tragedy’ in Uttrakhand High Court.
