Mumbai HC: Sexual Intercourse During Deep Love Affair Not Rape.

The Bombay High Court has acquitted a man in a rape case as there was a “deep love affair” between the accused and the complainant. The woman alleged that the man had sexual intercourse with her after promising to marry her but refused later. However, in her affidavit, she wished to withdraw the complaint due to personal reasons and emotions.

“It can thus be clearly seen that there was a love affair between the appellant and PW-1 and there was a clear consent, on the basis of which, the appellant and PW-1 had physical relationship”.
