Wherein any authority, specifically legislative exercises powers beyond its jurisdiction, then such exercise of powers is void ab initio.
For example- Article 13(2) of the Constitution Provides ‘that state shall not make any law which takes away or abridges the right conferred by Part III and any law made in contravention of this clause shall be the extent of the contravention be void ab initio.
In the context of Contract law a contract may be void ab initio this means that the contract must be treated as In valid from the moment that it was entered into rather than when the court made the decision on the matter.
